Nimer Law filed a mandamus lawsuit (also called writ of mandamus) against the Department of State, the US Embassy in Hyderabad, India and various government officials on behalf of an applicant for an H-1B renewal visa that was stuck in administrative processing for eight months. During that time, our client was unable to return to his employment and was separated from his wife and child who were still in the U.S.
We filed the lawsuit and were able to successfully obtain his visa through negotiations with the U.S. Attorney’s office even during the government shutdown. Our client returned to the U.S. yesterday and did not have any trouble clearing CBP inspection upon entry.
Our client was extremely happy with the outcome of his case. In an email thanking us for our work he said, “I could not have gotten through this situation without your support, hard work and dedication. Thank you so much for helping me get back to my family and my job!”
There has been a dramatic increase in administrative processing wait times over the past year, even for simple renewals for H-1B visa holders who have worked and lived in the US for years. Other affected individuals should contact our firm for assistance if they are facing a similar situation.
