Nimer Law is pleased to announce the successful resolution of another immigration delay lawsuit – in this case for an Iranian scientist in the EB2 category. The EB2 Green Card is for aliens who have demonstrated “exceptional ability” and is highly desirable because it can offer a relatively fast route to permanent U.S. residence. However, the presidential proclamation barring the entry of Iranian nationals has caused hurdles to many applicants who have been awaiting approval well past normal processing times.
Dr. B had been interviewed by the U.S. Embassy in Abu Dhabi back in November 2017 and had his visa approved a few weeks later. Upon approval, he submitted his passport the embassy and to his dismay the embassy sent his passport back without the approved visa and without any explanation. At the time the embassy had received his passport, the presidential proclamation was enjoined and so the embassy had no justification not to issue the visa as Dr. B qualified for the exemption for those with a bona fide relationship with a U.S. person or entity, and thus he did not even need to apply for a waiver.
Despite his repeated inquiries over the year afterward, the embassy failed to respond or explain why they did not issue the visa. Dr. B retained Nimer Law to file a lawsuit to compel the embassy to issue his approved visa, along with the visas of his derivative spouse and children.
Despite the government shutdown causing some delay for cases in December and January, we are happy to say that we were able to get Dr. B and his family their visas and successfully resolve the lawsuit within three months.
In an email expressing his appreciation, Dr. B said “surely we would not have reached this point without your support and hard work.”
Dr. B and his family are now making preparations to move to the U.S. so that Dr. B can begin his job with a major U.S. university. We are so happy that we were able to end a very long and stressful ordeal for this family.
