A.F. is an American citizen who filed an immigrant petition on behalf of her Iranian parents in June of 2017. On September 24, 2017, A.F.’s mother and father were interviewed, and on the very same day President Trump signed Presidential Proclamation 9645. A.F.’s mother was approved on the same day of their visa interview, however, sadly A.F.’s father was told that his petition would need to undergo administrative processing. A.F. contacted the Embassy repeatedly for one-thousand days by herself and via congressional inquiry, to no avail. A.F. and her parents waited for nearly two years for a decision on the application.
A.F. applied for a waiver for her father on the basis that he suffered from foraminal stenosis which results in severe back pain that requires surgery and constant help for even simple tasks. A.F. and her parents suffered emotionally, financially, and even physically for two years needlessly. Her parents clearly did not present any security risk, and yet her father was still placed in a seemingly never-ending state of administrative limbo.
On September 16, 2019, Nimer Law filed a lawsuit challenging the lack of adjudication of A.F.’s waiver request for her father. Nimer Law fought long and hard for a positive result and we are very glad that on February 3, 2020 A.F.’s father’s visa was finally issued!
